Terms of Service

You must be at least 18 years of age to use the Service. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

To access our indicators, you must create an account by providing a valid email address. After purchasing a subscription, you must provide your TradingView username so we can grant you access to the indicators.

You are responsible for maintaining the security of your account and for all activity that occurs under your account. You must not share your account credentials or indicator access with any other person.

BOSWaves offers paid subscription plans that provide access to TradingView indicators. Subscriptions are available on monthly, quarterly, and yearly billing cycles, and are processed securely through Stripe.

• Billing cycle — subscriptions are billed on a recurring basis (monthly, quarterly, or yearly) from the date of purchase, depending on the plan selected.
• No refunds — all sales are final. We do not offer refunds, credits, or exchanges for any subscription payments. If you cancel your subscription, you will retain access to your indicators until the end of your current billing period.
• No free trials — we do not currently offer free trial periods.
• Price changes — we reserve the right to change subscription pricing at any time. Any price changes will apply to billing periods beginning after the change. We will notify you of price changes in advance.
• Failed payments — if a payment fails, we may suspend your access until payment is successfully processed. We reserve the right to cancel your subscription after repeated payment failures.
• Promotional discounts — from time to time, BOSWaves may offer promotional discounts or coupon codes. Unless explicitly stated otherwise, all promotional discounts apply to the first billing period only. After the promotional period, your subscription will automatically renew at the standard listed price. Promotions cannot be combined, transferred, or applied retroactively to existing subscriptions. BOSWaves reserves the right to modify or withdraw any promotion at any time without prior notice.

You may cancel your subscription at any time from your account page or by contacting us at support@boswaves.com.

Upon cancellation, your access to indicators will remain active until the end of your current billing period. No partial refunds or pro-rated credits will be issued.

Upon subscribing, BOSWaves grants you a limited, non-exclusive, non-transferable, revocable licence to use the TradingView indicators included in your subscription plan for your personal, non-commercial trading purposes only.

You expressly agree that you will not:

• Share, distribute, sublicence, or provide access to your indicators to any other person or entity
• Resell, lease, rent, or otherwise commercially exploit the indicators or any output derived from them
• Use the indicators to operate a commercial signal service, copy-trading service, managed account service, or any other service that provides trading signals or recommendations to third parties
• Reverse-engineer, decompile, disassemble, or otherwise attempt to extract the source code, Pine Script logic, or underlying algorithms of any indicator or strategy
• Modify, adapt, translate, or create derivative works based on the indicators
• Remove, alter, or obscure any proprietary notices, labels, or branding associated with the indicators
• Redistribute the indicators in any form, whether free of charge or for payment

All indicators, strategies, documentation, branding, website content, and associated intellectual property are and remain the exclusive property of BOSWaves. Your subscription grants a licence to use — not ownership of — the indicators.

If you wish to use BOSWaves indicators for commercial purposes — including but not limited to signal services, fund management, proprietary trading firms, or educational content — you must obtain a separate commercial licence from us.

Unauthorised commercial use of our indicators is a material breach of these Terms and may result in immediate termination of your account and legal action.

We reserve the right to suspend or permanently terminate your account and revoke indicator access, without refund, if we reasonably determine that you have:

• Violated any provision of these Terms
• Shared your indicator access with others
• Used the indicators for unauthorised commercial purposes
• Attempted to reverse-engineer or redistribute the indicators
• Initiated a chargeback or payment dispute in bad faith
• Engaged in abusive, fraudulent, or harmful behaviour toward BOSWaves, its staff, or its community
• Provided false or misleading information during registration

In the event of termination for breach of these Terms, no refund or compensation will be provided. We may also pursue any legal remedies available to us.

If you believe a charge is incorrect, please contact us at support@boswaves.com before initiating a chargeback with your bank or card provider.

Filing a chargeback or payment dispute without first contacting us constitutes a material breach of these Terms. In such cases, we reserve the right to immediately terminate your account, revoke all indicator access, and ban you from future use of the Service. We may also pursue recovery of any losses incurred as a result of the chargeback.

BOSWaves indicators and strategies are tools for technical analysis only. They do not constitute financial advice, investment advice, trading advice, or any other form of professional advice.

All trading involves risk. Past performance of any indicator or strategy — including backtested results — is not indicative of future results. You are solely responsible for your own trading decisions and any financial losses that may result from them.

We strongly recommend that you consult a qualified financial advisor before making any trading or investment decisions. BOSWaves does not guarantee any specific results, returns, or profitability from the use of our indicators.

To the maximum extent permitted by applicable law, BOSWaves, its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or anticipated savings
• Loss of data or business opportunities
• Trading losses or financial losses of any kind
• Losses arising from reliance on indicator signals or strategy outputs
• Service interruptions, downtime, or technical issues
• Actions of third-party services (including TradingView or Stripe)

Our total liability to you for any claim arising from or related to these Terms or the Service shall not exceed the total amount you have paid to BOSWaves in the 3 months preceding the claim.

We strive to keep the Service available at all times, but we do not guarantee uninterrupted or error-free access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

BOSWaves indicators run on the TradingView platform. We are not responsible for TradingView's availability, performance, or any changes to their platform that may affect how our indicators function.

We reserve the right to modify, update, or discontinue any indicator, strategy, or feature of the Service at any time. We will make reasonable efforts to notify you of significant changes, but we are not obligated to maintain any specific indicator or feature indefinitely.

We may update these Terms from time to time. We will post the revised Terms on this page with an updated "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

If we make material changes, we will notify you by email or through a prominent notice on the website.

These Terms shall be governed by and construed in accordance with the laws of the Emirate of Dubai and the applicable federal laws of the United Arab Emirates.

Any disputes arising from or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and BOSWaves regarding the use of the Service, and supersede all prior agreements, representations, and understandings.
